The three farming families are not alone in their attempt. In many countries, climate change is already a concern of the courts. The Netherlands has already been sentenced to more climate protection. In Germany, an alliance of associations and citizens has sued the Federal Constitutional Court. Ten families are suing the European Union because they are affected by climate change in different ways and believe that their fundamental rights have been violated – but the European Court has dismissed the lawsuit.
The Berlin court granted the government leeway and pointed out that pollution rights could also be bought from other EU countries if their own goals were not achieved. The plaintiffs have not shown that the government’s climate protection measures were completely unsuitable and inadequate. The 2020 climate target is expected to be met three years later.
Greenpeace had supported the farmers in Berlin; according to the court, the organization itself has no right of action. Greenpeace expert Anike Peters said the court had failed to meet its potential.
